Apr. 19th, 2009 09:20 pmI know I have peeps out there who know the facts about this matter, so chime in please. I know I'm right, but just in case I've been doing this wrong for the last 30+ years, let me know.
I went to the bank Friday, to cash a BlueCross reimbursement for my last dental visit. The insurance is through Mark's company, so the check is made out to him. He endorses the back, gives to me, and I endorse under his name. I present the check to the teller.
Teller: This is made out to Mark. He'll have to be here in person with his ID to cash it.
Me: No, he endorsed it over to me, and see, I signed under his signature.
Teller: No, you can't do that, he has to cash it. Some people let it slip by, but I always check it, because I am legally responsible for this money.
Me: Yes you can, that's the very meaning of "third party check."
Teller: oh no, for him to sign it over to you, he has to write "pay to the order of" to you.
Silence, while I remind myself strangling idiots is a crime.
Me: Well then, would you please deposit it into our account?
Teller: Yes, we can do that.
While she's doing the deposit, I'm pulling out my check book and writing a check to cash for the amount of the check I couldn't just get cashed, and push it toward her.
Me: Is this some new Wachovia policy, or just this branch?
Teller: Oh no, this is a law.
Me: No, it is not.
Teller: more blathering about her legal responsibility, and law, and not policy.
I let her continue to talk, merely staring at her with the "my aren't you a pathetic little thing" look, until she winds down and stops. I let the silence stand for a few seconds.
Me: You are wrong. I believe that you believe that, I even accept that maybe you heard something like that in some training. But you are wrong.
she continued to repeat everything as I gathered up my money and left.
